General Contract Terms

GENERAL SELLING CONDITIONS

 

All the online orders that took place on this website by the clients of Associazione Allevatori del Friuli Venezia Giulia have the following selling conditions.

 

1. CLIENT LOGIN

To have access at e-commerce service that our Center offer, the client must login in our website. The client can sign in this website http://www.ctsmoruzzo.it/iscriviti/ after that the client can enter the data, an email address and a password.

The data entered by the client will be processed by Associazione Allevatori del Friuli Venezia Giulia respecting the privacy policy.

 

2. PURCHASE METHOD

The stallion catalouge is on the website www.ctsmoruzzo.it/prodotti/ for each stallion in the catalouge is described:

a) Genealogy of the horse and more info

b) One or more pictures under the genealogy

c) Total price

The orders placed on our website www.ctsmoruzzo.it wil be considered purchased only after sent the confirmation of the order (that the client should print and save) from Associazione Allevatori del Friuli Venezia Giulia to the email address of the client giving us at the registration.

After placing the order the client delcare to have read an accepter the condition of sales. The confirmation email will contain the order number, the type of order an the quantity request, the invoice details and the address where the order will be sent. In this regard we invite the clients to always check those data and, in case of mistake, to worn immediatly our centre Associazione Allevatori del Friuli Venezia Giulia.

The client can check in every moment the status of his order in the area of our website that the client can see after registration. The order status are: pending payment with bank transfer, check or PayPal, Payment accepted, payment error, being prepared, in line to refuel, cancelled, refunded, order on its way, delivered. If between two working days from placing the order the client did not recived the confirmation email of the order we invite the client to contact our centre Associazione Allevatori del Friuli Venezia Giulia at the phone number 0432 672184.

Associazione Allevatori del Friuli Venezia Giulia have the right, whose decision cannot be appealed, to reject the order. In case of missing of confirmation email from the clients, this one cannot pretend to be refund of contractual ans extracontractual damage, only the refund of the sum already recived.

Associazione Allevatori del Friuli Venezia Giulia have the right to edit in every moment the products on the catalouge or their prices. Obviously those edits will not effects the orders already palced.

Associazione Allevatori del Friuli Venezia Giulia always keep update the catalouge showing if some products are new, sold out, or waiting supplies. If, after placed a order, the product result sould out, Associazione Allevatori del Friuli Venezia Giulia will inform immediatly the client trought the email address of the client.

 

3.PAYMENTS

Associazione Allevatori del Friuli Venezia Giulia accept those paying metods:

PayPal.

This paying metod is menaged directly from PayPal with their own rules.

Associazione Allevatori del Friuli Venezia Giulia therefore will not be able to know the bank details of the client.

Bank Transfer.

In case of choosing the bank transfer as a paying method, the client must pay in the same day of the place of the order at the following bank details:

The purpose of payment has to be filled with the code recived at the confirmation of the order.

 

Only after reciving the amount request Associazione Allevatori del Friuli Venezia Giulia will preceed to send the confirmation and at the delivery as mention in the 5th paragraph (Delivery)

If after three working days the amout will not be recived we will consider the order cancelled.

Cash On Delivery.

In case of choosing cash on delivery as a paying method, the client has to pay the amount already mention in the invoice directly to the express courier at the moment of the delivery. The payment has to be done with cash or with check (previuosly agreed) made payable to Associazione Allevatori del Friuli Venezia Giulia.

In case of choosinf cash on delivery the total amout will presenta plus of €4,00 + 22% VAT.

 

4.INVOICE.

Associazione Allevatori del Friuli Venezia Giulia will send the invoice after confirmed order from the client, even with more than one product.

The invoice will have the price of every single product ordered, VAT, delivery cost, other additional cost if applied.

The invoice will be registered to the client using the personal data he registered in the website.

 

5.DELIVERY.

Associazione Allevatori del Friuli Venezia Giulia usind national and/or internatonal delivery can send fresh semen of the stallion shown in the catalouge in accordance with the Owner of the mare and/or a delegated. This service is guaranteed in the 24h delivery area, in condition that the order is placed before the 8.30 am, or before 10.30 am for the stallions of the centre. Deliveries will tak place in carrige forward and cariige paid invoiced. The service is subject to availablty of the breeding centre and to the place of delivery.

The purchase of fresh and/or frozen semen from abroad entail an obbligation to the reciever to report the arrival of biological content at health autority (valid only for Italy)

Accessory charges for purchase semen:

Cost delivery of fresh semen from abroad, including health certificate INTRA-EU € 115,00 + VAT

Cost delivery of fresh semen from national territory, including production certificate and packaging € 30,00 + VAT

Cost delivery of frozen semen from national territory, incudinf production certificate and  the rent of dry shipper € 80,00 + VAT. The unreturned of the dry shipper between 5 working days will charge € 15,00 + VAT a day.

The payments done with cash on delivery at the delivery involves an addittional charge of € 4,00 + VAT.

Associazione Allevatori del Friuli Venezia Giulia do not respond of delivery time of single vector indicated.

Late delivery of the 24h of biological material from abroad for unwanted will, at the client will be charged 50% of the charge for health certificate INTRA-EU.

The delivery place will be previously agreed with the clients or with the vet delegated.

Delivery will take place in wroking days (from tuesday to friday of abroad semen, saturday only Hold for Pickup, for semen leavin from Italy) with exeption of  national and international holidays.

The product will be sent in a suitable packaging fro biologic material. At delivery, the clients must check is the material recived corrispond to the D.D.T. and the packaging must be intact. Any discrepancy must be commincated to the centre through the website http://www.ctsmoruzzo.it/contatti/. in the section contact.

In case of uncorrispond order and delivery, the clients should not accept and REJECT the delivery. This is the only way Associazione Allevatori del Friuli Venezia Giulia can immediatly manage the documents of complanit and allows another fast delivery of  the same content. Associazione Allevatori del Friuli Venezia Giulia remind the client, without following the procedures shown above, will endorse fo acception the shipping document, the client cannot challenge what delivered.

 

6. GUARANTEES.

The prices of the stallions are pubblished and updated on the website of Associazione Allevatori del Friuli Venezia Giulia. The semen cost is normally the same of the one used by the centre abroad where the stallion is, with the purchase will be applied conditions of sales and guarantees of the centre of reference.

The purchase of the stallion in fresh and/or frozen semen can be, sometimes, supported or integrated with frozen semen of the same stallion, without extra charge, only delivery cost.

Please pay attention that if the insemination will be only with frozen semen (with a use maximum of 3) that doses not used will be property of Associazione Allevatori del Friuli Venezia Giulia.

The responsability of the packaging is of the centre of production.

During the breeding season the client can change the stallion only with another one of the same centre abroad.

Synthesis of guarantees we apply in case of no pregnancy on the 1st of October:
a) Breeding fee anticipated: the client can apply his guarantee by paying in the following year the 50% of the price of the previous year. This process is no considered if the first insemination is done before the 1st of july.

b) Breeding fee split, in advance and balance:the interruption of balance request has to be done by the client with a previous document, done by the vet, of non pregnancy by the 1st of October. The advance payment will be recognise in the follow year if the first insemination was done after the 1st of July.

c) Breeding fee for the stallions in our Centre: the advance payment will be regognise in the following year with a previous non pregnancy certificate by the 1st of October.

d) Purchase of Embryo transfer or ICSI: the breeding fee will be like the regular price. The client has to let know the number of the embryos taken, from the first will be asked the fee (if required). For every embryo taken, following the first, will be asked the total amount of the breeding fee. With this system, no guarantee will be applied in case of no pregnancy on 1st of October.

e) Particular purchase methods: no guarantee will be applied using straws or single dose, in case of no pregnancy on 1st October.

Associazione Allevatori del Friuli Venezia Giulia have the total control of frozen semen going out, providing the one conforms to the production standards, we do not take any responsability of any anomalies during the defrozing process. Regarding the purchases made throw our website www.ctsmoruzzo.it will be applied the provisions of the Civil Code at the artt. 1490-1495, and save the applicability in favor of the clients in person the favorable framework introduced by D. Lgs 206/2005 artt. 128-135.

 

7. EXCLUSION OF LIABILITY.

Under no circumstances Associazione Allevatori del Friuli Venezia Giulia  will appear responsable for delay or non-delivery of the express courier.

 

8.WITHDRAWAL

The withdrawal has to be done by the client by sending, within the deadline under penality of forfeiture, to a Associazione Allevatori del Friuli Venezia Giulia – Via 29 Ottobre, 9/B – 33033 Codroipo (UD) by register letter with acknowledgement of receipt using an explicit explenation of decision of withdraw od the contract. The proof of sending will be done by the mark of the poist office. The communications can be also done through telex, email, fax or telegram, in condition that between 48h will be confirmed by registered letter. In case that the client wants to exercise the right of withdrawal, has to provide at his own risk and cost to return possible items  which may have been received, intat and not used, with the original packaging, using an express carrier to Associazione Allevatori del Friuli Venezia Giulia – Via 29 Ottobre, 9/B – 33033 Codroipo (UD). In any case, we will not accept damage items, used items or return items to Associazione Allevatori del Friuli Venezia Giulia in countersign.

In case the client active the right of withdrawal, Associazione Allevatori del Friuli Venezia Giulia will provide between 14 days of the communications of withdrawal to reinburse all the payments done, beside the cost of return of the items. The reinburse will be done with the same paying method the client used for the initial transition unless otherwhise agreed.

 

9. APPLICABLE LAW AND PLACE OF JURISDICTION.

The purchase contracts done by the website www.ctsmoruzzo.it  are deemed entered in Italy, regulated by the italian law and subjected to Italian jurisdiction. 

Any dispute between Associazione Allevatori del Friuli Venezia Giulia and a client with VAT number, will be submitted by the place of jurisdiction of Udine.

Any dispute between Associazione Allevatori del Friuli Venezia Giulia and clients who are natural persons, will be submitted by the place of jurisdiction identified pursuant to art. 63 del D. Lgs. 206/2005 as amended.
